Court rules: TROTAMAR III: Detention unlawful

After the rescue of 22 people in the rescue zone coordinated by LibyaThe German sailing boat TROTAMAR III was taken into administrative detention and fined by the Italian authorities for non-compliance with the Piantedosi Decree.
After the objection lodged against the Court of Agrigento (Sicily) ruled that the detention of the boat must be immediately annulled as unlawful.

The court issued an urgent decision in which it responded to the complaint within a few days.
It justifies the suspension of the administrative seizure (detention)(RG n.2064/2025): It would only be permissible if the skipper had disregarded instructions from the Italian SAR authority. Since there was no instruction to communicate with the Libyan coast guard, taking into account "the special season, the summer, in which there is an increase in migratory flows in the Mediterranean," the detention was suspended.
The procedure continues until a final decision is reached, with CompassCollective continuing to demonstrate the injustice of the criminalising actions of the Italian authorities against civilian vessels carrying out rescue operations at sea,and will point out the inadequacy of the so-called Libyan Maritime Rescue Coordination Centre.

The lawyers of CompassCollective, Dario Belluccio and Francesca Cancellaro, are satisfied with the swift decision, which did not jeopardize the organization's activities.

Katja Tempel, spokesperson for CompassCollective, commented: "Once again, Italian courts show courage and revise overreaching administrative acts. Of course, we will continue not to involve the so-called Libyan Coast Guard in rescues. Our humanity forbids that."

About the case:
On the morning of August 24, 2025, the crew of the TROTAMAR III discovered a fiberglass boat in distress off the coast of Libya. After transmitting a distress call to the Italian and Maltese authorities, skipper Matthias Wiedenluebbert decided to take the 22 people directly on board to protect them from drowning and the threat of an illegal pullback to Libya by the so-called Libyan Coast Guard.
The previous evening, on August 23, 2025, at 9:15 p.m., the TROTAMAR III's freedom of movement was severely restricted and forced off course when a patrol boat of the so-called Lib. Coast Guard approached close to the port side and threatened to fire (firearms) over the radio. In this case, the crew was following a May Day relay from a Frontex aircraft and was forcibly prevented from fulfilling their duty to rescue at sea.

The TROTAMAR III has been conducting search and rescue operations off the Tunisian and Libyan coasts for two years. In 18 operations, the Italian Coast Guard rescued 2,345 people by alerting the responsible rescue coordination centers. They were assisted for hours by the crew of the civilian sailboat, providing them with life jackets and drinking water. To date, 417 people have been rescued directly onto the sailboat and brought to Lampedusa. The responsible skippers promptly and regularly inform the Maritime Rescue Centers in Rome and Malta, but refuse to share their positions and information about the shipwrecked people with authorities in Tripoli or Tunis.

The Compass Collective, with their sailboat TROTAMAR III, hails from Wendland, a region in Lower Saxony that has been dominated by the nuclear energy debate for 40 years. Civil society protest ultimately prevented a nuclear waste repository in Gorleben and is now providing the momentum to sail in solidarity against isolation and the deaths in the Mediterranean.

22 people rescued – sailing boat detained in port

After rescuing 22 people yesterday evening, a German sailing boat was prohibited from leaving the port of Lampedusa. The crew is accused of not informing the so-called Libyan coast guard when they rescued the people from an unseaworthy boat. The detention is expected to last for 10-20 days. It took effect yesterday.

On the morning of 24 August 2025, the crew of the TROTAMAR III discovered a fibreglass boat in distress off the coast of Libya, in which three women and 19 men had been exposed to the waves on the open sea for hours. After sending a distress call to the Italian and Maltese authorities, skipper Matthias Wiedenlübbert decided to take the people directly on board to protect them from drowning and an imminent illegal pullback to Libya by the so-called Libyan coast guard.

Already on the evening before, August 23, 2025, at 9:15 p.m., the TROTAMAR III was severely restricted in its freedom of movement and forced to turn away when a patrol boat of the so-called Libyan Coast Guard approached close to its port side and threatened to use firearms in radio communications. In this case, the crew had responded to a May Day relay from Sparrow 2 ("blue wooden boat adrift, approx. 30 people") and was forcibly prevented from fulfilling its duty to rescue people in distress at sea.

The TROTAMAR III has been conducting search and rescue deployments off the Tunisian and Libyan coasts for two years. In 18 deployments, 2,345 people have been rescued by the Italian coast guard after being alerted by the relevant rescue coordination centres, having previously been supported for hours by the crew of the civilian sailing boat with life jackets and drinking water. So far, 417 people have been rescued directly onto the sailing boat and taken to Lampedusa. The skippers in charge keep the maritime rescue centres in Rome and Malta updated regularly, but refuse to pass on the position and information about the shipwrecked people to the authorities in Tripoli or Tunis. "If we were to inform the so-called Libyan coast guard of a maritime emergency, we would be accepting that the refugees would be forcibly returned to Libya. This would not be a rescue, but an illegal pullback and thus an aid to the violation of human rights. This is neither compatible with applicable law nor with our conscience,' said Matthias Wiedenlübbert, skipper on board the TROTAMAR III.

Katja Tempel, press spokesperson for the Compass Collective, explains:

"If the Italian government, with the backing of many European states, wants to criminalise civilian sea rescue, then we will take them to court. We will take legal action against the detention of the TROTAMAR III and demand the implementation of the UN Convention on Human Rights: Libya and Tunisia cannot offer a safe haven (port/place of safety) for refugees, which is why we will not allow them to coordinate our rescue operations. Every day that a sea rescue ship is detained increases the risk of more people drowning in the Mediterranean."

The people taken on board the TROTAMAR III had set off from Zuwara (Libya) and come from Iraq, Somalia, Egypt, Sudan, Bangladesh and Ethiopia. They have been in Lampedusa since yesterday lunchtime and are being cared for in a hotspot by the Maldusa cultural association until they are taken to the Italian mainland.

52 people on the Mediterranean saved from illegal repatriation/pullback by Wendland sailing boat

Authorities do not respond to NGO SOS in the Mediterranean

At 11 o'clock this morning, the crew of the German sailing boat TROTAMAR III rescued 52 people in acute distress at sea, preventing an illegal pullback by the so-called Libyan Coast Guard.  These were refugees who had set off from Zuwara/Libya in a rubber dinghy.

Since 7 am., the sea rescue coordination centers have not responded to the distress call made by the crew after the sighting.

The 13m long sailing yacht Trotamar III has been on the route between Lampedusa and North Africa since August 2023 in its 7th mission to date. The CompassCollective searches the region for maritime emergencies and also rescues people itself in an emergency. On board the sailing boat are life jackets for 180 people, two centifloats (rescue hoses) and life rafts to keep people afloat in the worst-case scenario.

This morning, the crew had no choice but to take the people directly onto their boat. They are now being provided with water, tea, hot food and rescue blankets. Fuel burns (caused by a mixture of fuel and salt water) are also being treated on board.

Five days ago, on 16.6.2024, the crew of the TROTAMAR III tried to come to the aid of a boat in distress. This boat had already set off from Sfax/Tunisia on 10.6.24 and the 47 people on board had neither water nor food and had started drinking seawater in their distress. Unfortunately, the aid was blocked by an armed boat from the Tunisian coast guard, which ordered the skipper to leave Tunisian territorial waters immediately.

The crew of the Trotamar III and the 52 rescued people are now waiting for the urgently needed assignment of a safe harbor. Given the cramped conditions on the 13-metre-long sailing boat, there is no question that this can only be Lampedusa.

The reinforcement of the Civil Fleet in the Mediterranean comes from Wendland, the region in Lower Saxony that was shaped by the dispute over nuclear energy for 40 years. Civil society protest was ultimately able to prevent a nuclear waste repository in Gorleben and is now providing the tailwind to sail in solidarity against isolation and death in the Mediterranean.

52 persone nel Mediterraneo salvate dal rimpatrio illegale da una barca a vela del Wendland

Le autorità non rispondono agli SOS delle ONG nel Mediterraneo

Alle 11 di questa mattina, l'equipaggio della barca a vela tedesca TROTAMAR III ha salvato 52 persone in grave difficoltà in mare e ha impedito un rimpatrio illegale da parte della cosiddetta Guardia costiera libica.  Si trattava di rifugiati che erano partiti da Zuwara/Libia con un gommone.

Dalle 7 del mattino, i centri di coordinamento del soccorso marittimo non hanno risposto alla richiesta di soccorso lanciata dall'equipaggio dopo l'avvistamento.

La barca a vela Trotamar III, di 13 metri, sta percorrendo la rotta tra Lampedusa e il Nord Africa dall'agosto 2023, nella sua settima missione fino ad oggi. Il CompassCollective cerca nella regione le emergenze marittime e soccorre le persone in caso di emergenza. A bordo della barca a vela ci sono giubbotti di salvataggio per 180 persone, due centifloat (tubi di salvataggio) e zattere di salvataggio per tenere a galla le persone nel peggiore dei casi.

Questa mattina, l'equipaggio non ha avuto altra scelta che portare le persone direttamente sulla propria barca. Ora vengono forniti loro acqua, tè, cibo caldo e coperte di salvataggio. Anche le ustioni da carburante (causate da una miscela di carburante e acqua salata) vengono curate a bordo.

Cinque giorni fa, il 16 giugno 2024, l'equipaggio della nave TROTAMAR III ha cercato di soccorrere un'imbarcazione in difficoltà. L'imbarcazione era partita da Sfax/Tunisia il 10.6.24 e le 47 persone a bordo non avevano acqua né cibo e avevano iniziato a bere acqua di mare in preda all'angoscia. Purtroppo i soccorsi sono stati bloccati da un'imbarcazione armata della guardia costiera tunisina, che ha intimato al comandante di lasciare immediatamente le acque territoriali tunisine.

L'equipaggio del Trotamar III e le 52 persone soccorse sono ora in attesa dell'assegnazione di un porto sicuro, urgentemente necessario. Viste le condizioni anguste della barca a vela lunga 13 metri, non c'è dubbio che questo possa essere solo Lampedusa.

Il rinforzo della Flotta civile nel Mediterraneo proviene dal Wendland, la regione della Bassa Sassonia che per 40 anni è stata caratterizzata dalla controversia sull'energia nucleare. La protesta della società civile è stata in grado di impedire la costruzione di un deposito di scorie nucleari a Gorleben e ora sta fornendo il vento di coda per navigare in solidarietà contro l'isolamento e la morte nel Mediterraneo.
